I’d also like to acknowledge (but not thank) the American legal profession, without which these seventeen pages of legal caveats, disclaimers, warnings, acknowledgements, disclosures, waivers, copyright notices, citations, and credits would scarcely be necessary.
All opinions expressed on this site, except for opinions expressed in the Guest Book, are those of the webmaster, Anthony Atkielski, alone, and do not necessarily reflect the opinions of his past or present employers, any companies hosting his web sites, the owners of trademarks or logos appearing on his pages, or anyone else at all in the entire universe.
Opinions expressed by visitors in my Guest Book are their own and do not necessarily reflect the opinions of the webmaster, any companies hosting or providing access to this web site, the owners of trademarks or logos appearing on these Web pages, or anyone else. The webmaster reserves the right to remove guest-book entries at any time, without notice, and for any reason whatsoever. Failure to remove an entry does not constitute a waiver of this right, nor shall it be construed as an endorsement of any opinion(s) expressed therein.
Although the webmaster endeavors to link only to carefully-selected external sites, he expressly declines all responsibility for the content of other sites to which this site is linked and over which he has no control.
Although the webmaster has made his best effort to ensure that information contained on these pages is timely and correct, he cannot be responsible for accidental errors and omissions.
Content on this site, including but not limited to computer software, is provided “as-is” and without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The webmaster does not warrant that the content will function as documented or be free of errors, does not provide any technical support for the software or correction of errors or defects therein, and does not warrant that the content or this site or server upon which it is hosted will be free of viruses or other potentially harmful software entities. The webmaster additionally does not warrant or make specific representations concerning the use of software contained on this site or the results that may be obtained therefrom, with respect to correctness, reliability, precision and accuracy, or anything else. By downloading and using the software contained on this site, you assume full responsibility for any maintenance, reconfiguration, or corrections made necessary thereby. Additionally, if you download images from this site for your own use with the implicit or explicit permission of the webmaster, you agree and accept that you assume full responsibility for any property or model releases, licenses, or other authorizations obtainable from third parties that may be necessary for your intended use of the images in your applicable jurisdiction, and you agree to indemnify and hold harmless the webmaster, his agents, and his assignees against any legal action instituted against you or them by third parties for any infringement or other tort or crime in intellectual property law. This disclaimer remains in full effect even if you choose to voluntarily contribute to the site by sending money to the webmaster.
When conducting business with us based on any contact originally established through this site (such as an e-mail address or form obtained from or used on this site), you accept and agree that e-mail sent to you by us is deemed sent for legal purposes at the time the last e-mail server under our direct control transmits or attempts to transmit the e-mail to any other server en route to you. You assume responsibility for any loss of e-mail due to any spamming or other filtering policy that your ISP or any system under your control or operating in such capacity at your request or on your behalf may enforce. You additionally agree that any obligation to us of which we notify you by e-mail is not eliminated by your failure to receive the e-mail because of said filtering or spamming policies. Finally, this disclaimer remains in effect irrespective of any bounce messages send by the aforementioned systems under your control or direction.
This site may collect information concerning visitors in either of two forms: (1) automated logging of all visits to the site for the purposes of collective statistical analysis and security auditing; and (2) voluntary collection of information volunteered by visitors, in the form of feedback (via the Feedback page), entries in an online, public guest book (via the Guest Book page), and subscriptions to mailing lists (via the Feedback page).
Logging of visitor activity is carried out automatically by the system and includes information concerning every access to the site by every visitor. The accumulated logs thus produced, which contain information on IP addresses, dates, times, pages visited, browser types, and URLs referenced, are analyzed by the webmaster to prepare collective statistics on site usage and to audit for possible security problems; they are then discarded. No long-term record of site logs is kept. Information in the logs is not shared with any other party except where legally required. The logs in themselves do not permit direct identification of visitors to the site.
Feedback generates private e-mail that is sent directly to the webmaster. This e-mail is retained by the webmaster for a variable period, depending on the subject matter and the need for a response to the e-mail, if any. Information in feedback messages is not shared with any other party, except where legally required.
The Feedback and Guest Book forms attempt to include information on the visitor’s screen size in the messages they send to the webmaster; this information is used collectively and statistically by the webmaster to determine what sizes should be used for wallpaper images and gallery images displayed on the site.
The public guest book on the site allows visitors to leave publicly-visible comments on the site. The Guest Book page also generates an e-mail summary of each comment that is sent to the webmaster and retained by him for a variable period. The comments entered into the guest book are visible to all visitors to the site; however, unless the visitor indicates otherwise when signing the guest book (by checking an appropriate box on the form), his or her full name is hidden, in order to protect privacy. (The visitor‘s e-mail address, if provided, is never published on the public page in any case.) This allows visitors to provide full names and e-mail addresses to the webmaster (in order to receive a thank-you note, for example) without revealing this information to the general public.
The Mailing Lists page allows visitors to subscribe to a mailing list to which news concerning changes and additions to the site is sent periodically by the webmaster. The list of persons on the mailing list is not shared with any other party (except where legally required), and the list is not used for any other purpose than the purpose described here. The addresses of visitors are retained on the mailing lists until the visitors request that they be unsubscribed, which they may do at any time.
Visitors who wish to be removed from any mailing list and/or have their comments removed from the site guest book may request either of these directly from the webmaster. All requests are carried out as soon as possible upon receipt of the request.
Use of feedback, guest book, and mailing list functions of the site is entirely voluntary and is not required of any visitor at any time as a condition of his visit. No part of this policy shall be construed to guarantee any retention of any information collected from visitors for any purpose or duration.
This site may use a cookie to identify visitors who have made donations to the site in order to give them access to additional content. The cookie doesn't contain any personal information about the visitor.
By using this site and in consideration thereof, you agree to grant to the webmaster and his agents, representatives, and heirs a perpetual, irrevocable, worldwide, non-exclusive, transferable, and fully-paid license for the contents of any e-mail you send to the webmaster using any address mentioned on this site, as well as for any content of any guest-book signature you submit, including but not limited to both text and attachments. You accept that this grant remains in force no matter what text to the contrary you may include in the e-mail or guest-book signature. You additionally agree that this grant shall be and remain binding upon your agents, descendants, and heirs. You waive any claim to confidentiality of any part of the contents of such e-mail or guest-book signature and you understand and accept that any or all of the contents may be published in any form (present or future) at the webmaster's sole discretion and in unlimited exercise of the license that you unconditionally grant to the webmaster by and with the sending of the e-mail, and/or the submission of the guest-book signature or other content. You represent and warrant that you hold or are entitled to dispose of all rights in any of the content you send, and you agree to indemnify and hold harmless the webmaster from any action taken against him by anyone as a consequence of any failure on your part to secure unencumbered title or disposal authority over all rights inherent in the content you send.
The webmaster shall not be liable for any special or consequential damages resulting from the use of, or the inability to use, software or any other information, files or data contained on this site, under any circumstances. This is true even if the webmaster and/or his agents and/or representatives have been advised of the possibility of such damages. In no event shall the webmaster be liable to you for any damages, losses, and causes of action (whether in contract, tort [including, but not limited to, negligence] or otherwise).
The above constitutes the entire agreement between you and the webmaster. It replaces and supersedes any previous agreement established by means of these Web pages. Any portion of the above that shall be unlawful, void, or unenforceable for any reason, shall be deemed severable from this agreement and shall not affect the validity and/or enforceability of any remaining portions of the above.
